9 - What is a plea offer or plea bargain?

A plea bargain is an offer extended by the prosecutor in which the prosecutor agrees to reduce the charges against you in exchange for your guilty plea.  Only prosecutor can extend a plea offer.  The judge cannot make the prosecutor extend a plea offer and the judge cannot make the prosecutor change the plea offer.  However, a good Phoenix criminal defense attorney will often negotiate on your behalf to ensure that the prosecutor extends the most favorable plea bargain available.  In order to ensure a favorable plea bargain, a good Phoenix criminal defense attorney will thoroughly investigate the case for holes, omissions, and other constitutional violation and attack the state’s case for weaknesses.  A good criminal defense attorney will also present any mitigating evidence on your behalf and a criminal defense attorney experienced in Phoenix sex crimes may submit a psychosexual evaluation when applicable.
