11 - How can the prosecutor give somebody else who committed the same crime as I did a better deal?

In the state of Arizona, the prosecutor is the only person with the power to extend a plea offer. The prosecutor can refuse to extend a plea offer or extend a plea offer that is inconsistent with an offer extended to a different defendant facing similar charges.  Because the prosecutor is given this sole power, there is absolutely nothing that a judge can do to force the prosecutor to extend a plea offer or to change the prosecutor’s mind about a current plea offer that has already been extended.  However, a good Phoenix criminal defense attorney will often negotiate on your behalf to ensure that the prosecutor extends the most favorable plea bargain in your sex crimes case.
