3. What factors does the state consider to decide if they will reduce my drug charges?


The most significant factor the state will consider to decide if they will reduce your drug charge is your criminal history and the nature of the alleged offense.  If, for example, you are charged with Possession of Marijuana and you are a first time offender, the state may designate the offense a misdemeanor immediately and send you to city court to deal with the drug charge at the lower court level.  If, however, you have a lengthy criminal history, the state may be unwilling to reduce your charges at all and you will be forced to fight your case in felony court.  If you are concerned about the possibility of a felony conviction, the best course of action is to retain an experienced Phoenix criminal defense attorney to aggressively attack the state’s evidence and defend your rights.
