10. Is Domestic Violence Assault a felony or a misdemeanor?


A Domestic Violence Assault can be charged as a misdemeanor or a felony depending upon the facts and circumstances surrounding the case.  If a deadly weapon or dangerous instrument is used, a criminal defendant will likely be charged with Aggravated Assault, a dangerous felony offense which carries a mandatory prison sentence of 5-15 years.   Similarly, felony charges will likely be filed if serious physical injury or other permanent physical injury is caused to the alleged victim.  If you find yourself charged with felony assault charges or any other felony domestic violence offense, it is crucial to retain experienced legal counsel as your personal liberty and freedom is at stake.
